These Terms of Use (“Terms”) govern your access to and use of the Bay 12 Motor Co.website (the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

You must be at least 18 years of age and legally capable of entering into a binding contract to use this Site.

Vehicles displayed on the Site are offered subject to availability and prior sale. Listed prices are for the vehicle only and exclude sales tax, title, registration, documentation and any other applicable fees, which are disclosed before any purchase is finalised.

We reserve the right to correct any error, inaccuracy or omission — including in pricing — and to change or update information at any time without prior notice.

Nothing on the Site constitutes a binding offer to sell. Listings are an invitation to enquire and do not reserve a vehicle or fix a price. Any purchase is governed exclusively by the written purchase agreement and related documents executed at the point of sale, which prevail over any information on the Site in the event of a conflict.

We make reasonable efforts to describe each vehicle accurately, including its specification, mileage, condition and any known defects. Descriptions and photographs are provided for general guidance and are not warranties. A vehicle's condition may change between listing and inspection.

You are responsible for satisfying yourself as to the condition and suitability of any vehicle before purchase, and we encourage independent inspection. Where a vehicle is sold without a warranty, it is sold as-is, and the terms displayed on the vehicle and set out in the purchase documents govern.

Where a vehicle identification number is published, you may obtain an independent vehicle history report from a third-party provider. Such reports are prepared by those providers and not by us. We do not control and are not responsible for their accuracy or completeness.

You may view, browse and share listings for personal, non-commercial purposes. You may not:

• copy, scrape, harvest or republish Site content in bulk;
• use the Site to send unsolicited commercial communications;
• attempt to gain unauthorised access to any part of the Site, or interfere with its normal operation; or
• use the Site for any unlawful purpose or in violation of these Terms.

The Site and its content, including text, photographs, graphics and design, are owned by or licensed to Bay 12 Motor Co. and are protected by intellectual property laws. Vehicle manufacturer names, model names and logos are the property of their respective owners and are used solely to identify the vehicles offered for sale.

The Site may contain links to third-party websites and services. Those links are provided for convenience only. We do not endorse and are not responsible for the content, products or practices of any third party.

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement, in relation to the Site and its content. We do not warrant that the Site will be uninterrupted, timely, secure or error-free.

This section applies to the Site only. It does not limit any warranty provided with a vehicle, or any rights you have under consumer-protection law.

To the fullest extent permitted by law, Bay 12 Motor Co. and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenue, arising out of or relating to your use of the Site, whether based in contract, tort or any other legal theory.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, or affects your statutory rights as a consumer.

You agree to indemnify and hold harmless Bay 12 Motor Co. from any claim, demand, loss or expense, including reasonable legal fees, arising out of your misuse of the Site or your breach of these Terms.

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

We may revise these Terms at any time. Revised Terms will be posted on this page with an updated effective date and take effect when posted. Your continued use of the Site following any change constitutes acceptance of the revised Terms.
